Abstract
The proposed article is devoted to collective labor disputes (conflicts) and the procedure for their resolution, and accordingly to the problems that have developed in the current conditions. The current legislative and regulatory framework only partially meets the needs and interests of the parties regarding the effective resolution of collective labor disputes. From the experience of facilitating the resolution of collective labor disputes (conflicts), implementing the decisions of conciliation bodies, I believe that the development of special-jurisdictional principles of out-of-court protection of the right to work is one of the important tasks that will determine the content and further prospects of resolving labor disputes in Ukraine. The formation of conceptual approaches for the development of an effective system for the resolution of collective labor disputes in labor legislation must correspond to the modern realities of European standards, the recommendations of the International Labor Organization and the best international experience. In addition, the article will consider the prospects for the development of labor relations in Ukraine through the creation and introduction of a new system for resolving labor disputes. Therefore, the reform of the labor dispute resolution system should be based on such general principles as the rule of law, legality, democracy, humanism, equality of parties and special principles, such as: dispute resolution based on social dialogue, prompt resolution of disputes, simplicity and accessibility of the procedure for resolving labor disputes. With this in mind, one of the important tasks currently being worked on by the National Mediation and Conciliation Service is the harmonization of national legislation on the resolution of labor disputes with European standards.
